Brandon Daniel struggled with a police officer while in a drug-induced stupor at a Walmart in Austin Texas. During the struggle, Brandon's pistol discharged and the officer was killed. Though some seven hours later, Brandon was tested for drugs and was found to have 7 times the normal dose of xanax, the DA used his 'confession' during the trial. It shouldn't have been admissible. He also did not display pre-meditation. Objectively, the worst he should have been charged with was involuntary manslaughter.
