The Ohio Supreme Court denied an emergency request to stop tomorrow's scheduled execution of James J. Filiaggi. The U.S. District Court this afternoon rejected Filiaggi's appeal to become part of an existing inmate lawsuit challenging lethal injection. The 6th U.S. Circuit Court of Appeals would be the next stop if Filiaggi continues his fight. Ohio executes inmate who killed ex-wife Associated Press LUCASVILLE- A killer who decided in his final days to fight his death sentence was executed Tuesday for hunting down his ex-wife and shooting her in the head. James Filiaggi, 41, had given up his appeals in 2006 to speed his sentence, but reconsidered last week. Before he died by the injection that he argued amounted to torture, Filiaggi criticized the death penalty in his final statement, saying many innocent inmates are on death row. "For me-- it's fine," he said. Filiaggi had hurt and threatened his ex-wife Lisa Huff Filiaggi before she was killed 13 years ago in Lorain.
