A 23-year-old Newark man pleaded not guilty Monday in the shooting death of a San Leandro police officer.
Irving Alexander Ramirez entered his plea at the Hayward Hall of Justice in the July 25 slaying of Officer Nels "Dan" Niemi, 42.
Ramirez is scheduled to return to Alameda County Superior Court in Oakland on Oct. 3 to schedule a preliminary hearing on charges of murder with special circumstances: killing a police officer, lying in wait and killing to avoid arrest. If convicted of any of the special circumstances, Ramirez could face the death penalty.
Police said Ramirez, a convicted methamphetamine user, shot Niemi seven times with a 10mm semiautomatic handgun as the officer prepared to run Ramirez's name on the radio while checking out a noise complaint on Doolittle Drive.
Ramirez, who was on probation, was afraid that he'd be sent back to jail because he was carrying drugs and two guns, authorities said.
