Capital murder is a murder which is punishable with death. Different states have different laws, the same murder can be capital in one state and a 1st degree murder in another, for example.

Capitol murder is, in Texas, the murder of a police officer or fireman, while on duty, muder in the commission of a felony, such as rape, robbery, murder, murder for payment, etc, murder while on escape from prison, murder of a child under a certain age.

Ok... I see... but all this is too complicated.. we really have a different order about criminal laws.. anyway.. how's that anyone can be convicted with death penalty both for murder and capital murder then?

ok.. sorry.. and thanx for trying to understand...even with my " language limits"... I'ive always thought that a person could be condamned with a death sentence only for a capital murder ( and I didn't know what a capital murder was... becouse we don't have this distinction here in Italy) Instead i see that someone can be convicted with a capital sentence also for murder and not only for capital murder... how is it possible? I've asked this becouse at this point. I thought it was only a different name to call the same thing... ela

I am not sure I understand what you mean, but I think maybe you are asking how can someone get the death penalty when there are no death penalty specifications? Or are you trying to find out why some murderers don't get the death penalty?

I mean... how can someone get the death penalty for a murder if ONLY capital murder is punishable with death penalty?? Are capital murder and murder then same thing then? Or death penalty is more easy to get than what we think?

Ela,
When someone gets comvicted of murder that murder is a capital murder. People only get sentenced to death for capital murder (actually for murder - but capital since its punishable with death). So in some cases it is the same, but it doesn't have to be.
