DURANT — The Bryan County District Attorney’s Office is seeking the death penalty for a man charged with first-degree murder for the May slaying of Tristan Ace York.
A bill of particulars was filed against Charles Shannon Bussey, 41. Court papers state Bussey should be punished by death because the murder was especially heinous, atrocious or cruel and York suffered physical abuse prior to his death due to a prolonged beating.
Bussey pleaded not guilty during a formal arraignment Tuesday.
Bussey and Bobby Don Mullinix, 24, were both charged with first-degree murder after York’s body was found in the Rock Creek area of Lake Texoma.
Papers filed by the district attorney’s office state that witnesses testified that York, 27, was beaten with a baseball bat and fireplace poker, stabbed with a bayonet and knife, and shot in the head multiple times.
According to court papers, York pleaded with the defendants to stop beating him.
“Such beating, stabbing and shooting of Tristan York amounted to torture of him prior to his death,” court papers state.
Prior to the shooting, the defendants, according to statements from witnesses, discussed whether they should take York to the hospital or “finish him.”
The district attorney’s offices alleges that Bussey and Mullinix decided to kill York because they were concerned that he would tell police about the beating. The slaying happened at a Meadow Lark Lane home.
Linda Gayle Haworth, 44, was charged with accessory to first-degree murder in the case.
Assistant District Attorney Tim Webster said no decision has been made on whether to seek the death penalty for Mullinix, who has not been brought back to Bryan County due to cases against him in Texas. That decision will be made after Mullinix is returned for a preliminary hearing. No time frame has been set on that, pending resolution of the other cases against him.
Bussey is being held without bail.

" The key witness of this hideous murder died 5 days before the preliminary hearing. I wonder if his death was related in some obscure way. Hopefully the investigators are looking deeper into that as well. Too much of a coincidence. "

I feel so sorry for what york went through no one should have to go through such torture. if it was up to me them two would go through something worse. than what poor york went through. if i had a choice to see the two i would give them a piece of my mind.I have to right to face them since bussey hurt someone in my family he needs to pay big.linda haworth should of been a good person and ran to a neighbors house she may of saved his life if she would of done the right thing she is just as bad as they are since she just stood and watched how sick is that. just put me in the room with them three with a baseball bat. god bless the york family. I lose a son two murder years ago i am still just as mad as i was back then. and when i hear things like this it makes me really mad where is the justice system what would happen if it was there family. "

" The death penalty needs brought into play in alot of cases. This is without a doubt, one of them. Anyone who could do such to another person don't need to take another breath. And in a whole different story, it needs used in the child molesting cases that we are seeing more and more of, right here in our home town. "

" I do not know either Bussey or Mullinix personally, but I have looked into this story fairly extensively. I know about it from news stories and background checks, but also from the deceased witness's accounts as well.
I find what happened to Tristan to be incredibly heinous. I can't comprehend how anyone could do something like this, however, I was a little surprised that Bryan county wants to seek the death penalty for Bussey. My understanding is that what happened was out of character for him. I would have thought the plea would be for a life sentence instead, in hopes that he could make right his wrongs with both the family of the victim, but also his Maker.
I am in no way condoning what he did, but it seems that the backgrounds of both accused parties should be examined thoroughly.
My understanding is that this behavior is not out of character for Mullinix. I would think he would be the likeliest of the two to receive the death penalty, as this crime probably wouldn't have occurred had he not been out on the streets and paranoid.
Keep in mind that he was released when he was a wanted man in Texas, therefore, I feel that Bryan county should take into consideration some of its own responsibility in this matter.
I do want to extend my deepest sympathies to the family of Tristan. Their loss has no doubt been very devastating and traumatic for them. My prayers are with them and also the people who make the decisions in this town, that they may make the right decisions in the case of ALL parties involved in this situation, including the witness whose death was unusual before the trial.
Be honest in this matter please, Bryan county. You allowed Mullinix to get out of jail when he shouldn't have had that opportunity. "
