I will throw my hat into the ring with this... He was on Death row...Check He had appeals...Check He died of CANCER...Check He was NOT EXECUTED...Check Where is the problem? Other than medical care... DNA did clear him, but cancer was the killer, not the state of florida. You jocking?!?!..tell me it is just a joke…..ooooohhhh nooooo..now I understand, how stupid girl I was all the time..my eyes are opend now: you are in fact anti DP, just pretending to bi pro to make them stupid. Well maybe your intentions were good, but we need to play fair! Don’t do that any more..we are honest people! Hey Mike, there is no more send in this dessert to dig your head into…<br>

Mike - your arguments would have a lot more credibility if you would at least concede obvious points. But since you won't; it would make the uninvested; middle of the fence reader question all of your opinions. You don't debate by closing your eyes; sticking your fingers in your ears and going "la la la la la la I can't hear you".
And it SURE looks like you are doing that.

What fantasy land do I live in...He was not executed. It is wrong to deny medical care to anyone. Why was testing not done when he was alive, I do not know. DNA testing in various forms was done for a while now. I do not know why it was not done in this case.
Why he was not given medical care I also do not know. I will be the say that he did need and did deserve it.

What points...he was not executed...He died an awful death. Bush can clear it by giving a pardon, but it does not do any good. The question I have is why his lawyer did not demand a DNA test earlier...

Did you READ the articles? n August of 1998, with advanced DNA testing (finally) available, the defense filed a motion to test Smith's DNA. One month later, a new evidentiary hearing began, dealing again with Chiquita Lowe's credibility as well as the issue of the third line-up. Was Chiquita Lowe shown a picture of Eddie Lee Mosley in that line-up, as claimed by Det. Richard Scheff? Following the hearing, the judge denied the motion for a new trial, and also denied the testing of Frank Lee Smith's DNA. Frank Lee Smith's counsel filed a motion asking the judge to reconsider these rulings. When Frank Lee Smith died of cancer in prison on death row in January 2000, the judge had not yet ruled. In November 2000 -- 10 months after his death -- Smith was exonerated after the state of Florida, pressured by the defense, reluctantly allowed his DNA to be tested against what was left in Shandra Whitehead's rape kit. TEXTdid u read that ? Following the hearing, the judge denied the motion for a new trial, and also denied the testing of Frank Lee Smith's DNA.

He had his day in court. I never said that the system was perfect. I never said that I was perfect because I certainly am not. He had every chance, but somehow the system failed him and the little girl, creating two victims. I will say that denying medical care to anyone is even worse than anything. Basic human dignity alone demands that, as does the law. Prisoners are supposed to have medical care. One of my uncles retired recently. He was a dentist for the TDCJ. he provided dental care for 22 years in various units.

DNA could have been done earlier...Why the judge was an ID-10-T I do not know...
However, the system did fail here.

You never said the system is perfect. You said ONE innocent death row inmate would be too much for you. I believed you and even thanked you for showing me thinking people could be pro DP. Well I guess I was wrong.
Cause you were either lying, or your not a thinking person. One or the other.
Anyway I am done wasting my time answering u on this now. You need to think about how easily you are willing to write away someone elses life. If it was you or your beloved wife lying there dying cold and hated and screaming for 14 years; you would have something different to say. I guess Frank Lee Smith's life wasn't important enough to even make you stop and think for a second.
In Memory Of Frank Lee Smith. I am sorry that your country; that people like Mike; let you die and then call it justice. I hope for a better world someday; where people care just as much for others as they do for their own.

What are you wanting from me...He had all the court stuff we allow. Why DNA was not done earlier I do not know, I was not his lawyer. I was not the judge. I was not in Florida at the time...
