Prosecutor to decide any more charges in shooting

LORAIN -- Police said yesterday that any more charges in the case of a slain 15-year-old South Lorain girl will be ''up to the prosecutor'' as they continue to investigate the murder.
Adrian Lindsey, 19, was arrested Wednesday and charged with the murder of Samarrie Soler, 1719 E. 30th St., who was shot in the head late Tuesday night while watching television in her home with her family.

Lindsey allegedly fired the shots from outside in retaliation of an earlier incident, according to police.
According to Lorain Police Sgt. Mark Carpentiere, three boys went to Samarrie's house with Lindsey, but one boy left before the shooting. Police have identified and interviewed both boys who were with Lindsey when he allegedly shot at the house, he said.
Both boys and other men who were with Lindsey before and after the shooting are cooperating with police, Carpentiere said. Lindsey and his friends were shot at earlier in the evening and thought the gunman lived in the Soler house, police said.
Carpentiere said the decision to charge anyone else is not up to police.
''We are leaving it up to the prosecutor (to charge them) after hearing all the testimony.'' He added, ''Some may face charges later. It could be one or many who are charged. We will see once the facts come out of the grand jury.''
If charged, the other boys may face aiding and abetting and complicity charges, according to Carpentiere. The names of the two boys are not being released because they have not been charged.
Whether the additional suspects will be charged ''depends on what they did and why they did it,'' said Lorain County Prosecutor Dennis Will. ''Because there is a lack of information, they haven't been charged.''
Will said the suspects could be subpoenaed to serve as witnesses to a grand jury in Lindsey's trial.
Lindsey pleaded not guilty to charges of murder, tampering with evidence and discharging a firearm into a residence at his arraignment Thursday.
Capital punishment could be ''a possibility'' if Adrian Lindsey is convicted of shooting and killing Soler, Will said.
He explained there are nine instances that must be considered before capital punishment can be sought, such as terrorizing a victim or killing someone under the age of 14.
He said Lindsey's file is still under review, so he could not comment on which instances Lindsey may meet.
A rally inspired by the death of Samarrie and designed to ''promote pride and stop violence in the neighborhood,'' will be held this Sunday, August 28 from 5 to 7 p.m. at Library Park, 329 W. 10th St.
