HC Confirms Death Sentence On Karthik Raj's Slayer

The Bombay High Court upheld a sessions court judgement and confirmed the death sentence on one accused and life imprisonment on two others holding them guilty for the murder of Pune-based national tennis champion Karthik Raj on August 8, 2001.
A division bench, comprising Justice Ranjana Desai and Justice Dilip Bhosale, confirmed the death sentence and life imprisonment accepting the prosecution argument that it was the rarest of the rare case which needed stringent punishment.
According to the prosecution case, the accused Santosh Bariyar, Sanjeev Kumar Roy, Santosh Kumar Roy and Kumar Gaurav had brutally murdered Raj after kidnapping him and had later cut his body into pieces and threw them across different parts in Pune.
The accused, after committing the heinous crime, had telephoned Raj's father in Hyderabad and demanded a ransom of Rs 10 lakh stating they had kidnapped his son.
All the accused were arrested from Mumbai on a tip-off by the crime branch CID, Pune.
One of the accused, Kumar Gaurav, turned an approver and delivered evidence against the other accused.
The Pune sessions court had examined 58 witnesses and on May 18, 2004 awarded death penalty to Santosh Bariyar and awarded life imprisonment to Sanjeev Kumar Roy and Santosh Kumar Roy. Kumar Gaurav, the approver, was granted pardon.
Since one of the accused was awarded death penalty, the State made a reference before the high court for the confirmation of it and also filed an appeal for awarding death sentence to the other two accused
