I came across this today:
Overstreet and Hagood, pleaded guilty in return for their testimony against Cartwright. Overstreet, now 27, was sentenced to 50 years in prison on a murder charge for stabbing Moraida. Hagood, now 28, was sentenced to 20 years for robbery. Cartwright also was offered a plea deal that included 40 years in prison, but he turned it down. His defense attorney, Mark Woerner, said Cartwright rejected the deal because he "would prefer death over 40 years" in prison.

Not uncommon for someone who is facing 40 years for something they don't feel they were responsible for.
A LOT of people refused pleas; thinking the jury would see things their way; and later were executed.
I hear from MANY death row prisoners that they prefer death to life in prison. A lot of DR prisoners argue with us prisoner advocates about that....

I know. If he would have said yes, he could have been out in 20 years. He would have already served half of his sentence. I can understand though.

i mentioned this yesterday; but its like in Jimmy Dennis - he was offered a deal too; he looked at them and said "Deal? ? An innocent man doesn't make deals" If you know you did it; 40 yrs sounds better than taking a chance on death... If you don't think you are that culpable - or as in Jimmy Dennis if you are factually innocent - you'll take your chance on a jury; then with the weight of the state on you; its harder than u think to prove innocence...thats why there is a higher percentage of innocents or wrongly convicted on DR than in regular population

We don't allow deals in our justice system because it is not considered thustworthy evidence.

Justice - OF COURSE - you are right. It goes without saying!!! But we SHOULD say it.... Rest in peace Nick Moraida - I hope you are in a better; and more accepting place; and that you can somehow feel the love of your family and friends who still mourn your loss. for Nick and his family for Richard and his family

Richard told me himself that he didn't take the plea offer because he never thought he would end up on death row. He thought his innocense would save him.
In his trial transcript, it states that he either wants death row or aquited. The words of an innocent man.

If I was innocent I would'nt accept a 40 yr deal, I would of done exactly what Richard done, which is to fight and pray that everyone will see that your innocent, and you will be free..

How is Richard's mother doing? Does Riki know what happend to her dad yet? I did sign his petition the night before the day he was killed. I guess it just was'nt enough

Richard aka chi-town I never knew you but i was forever reading your uncensored. Everyday i would check for any latest news about you on the internet. I sent letters to people asking them to spare your life. It felt so much that i knew you through all your writings. I prayed all day on the day of your execution,prayed you would get a stay. I listened online to KDOL,i heard your mum and your daughter. I heard all the love people had for you Richard. On the 19th when i heard the news they had executed you it was like i had lost a friend. Strange id never met you in real life but you did have a place in my heart. I cried for you Richard,i cried for your mum,daughter,sister,family and loved ones who had lost someone they loved. Richard your love will remain with everyone you left behind. Is behind the right word?? I know your still with them in there thoughts,prayers. Texas executed an innocent man that night. A beautiful, kind man. Your free from the hell you lived on death row now Richard. Like a free bird you can spread your wings and fly safe to the arms of god up above. RIP Richard Cartwright aka chi-town You maybe gone but you shall never be forgotten.
