Please wear a black armband tomorrow, 5/19/05, in silent protest of the executions of Richard Cartwright by the state of Texas and Garry Allen by the state of Oklahoma. Mr. Cartwright is scheduled to die for the August 1996 murder of 34 year-old Nick Moriada. Mr. Allen will be executed for the November 1986 death of his girlfriend, Lawanna Gail Titsworth.
Richard Cartwright is most likely innocent of this crime. He and two long time friends whom he had just met were accomplices in the robbery and murder of Mr. Moriada. One of the accomplices owned the gun that killed the victim. The medical examiner testified that it in most such crimes the owner of the weapon is the one who uses it. He further testified that as the victim was assaulted by two people, it is likely that the two accomplices who knew each other did the crime together, not the newcomer Mr. Cartwright. Common sense, plus a professional medical examiner, says that Richard Cartwright is innocent of murder in this case.
Garry Allen is clearly not competent to be executed. The Oklahoma state Board of Pardons and Paroles has overwhelmingly recommended clemency. The facts of this case are compelling. Mr. Allen killed during a domestic dispute, his intent made not his own by an incapacitating mix of effects from childhood head trauma, epileptic blackouts and volumes of alcohol. During his arrest an officer’s gun fired accidentally and caused permanent brain damage to Mr. Allen. He has already been found incompetent for execution once and sent for treatment. Although little seemed to have changed, he was released and the issue of competence was put to a jury. The state denied the defense access to key neuropsychological evidence, and the jury found Mr. Allen competent using a now defunct legal standard. As a matter of humanity and of legality, Oklahoma may not execute Garry Allen.
